Abstract

Legal accountability is a person's obligation to bear the legal consequences of their actions in accordance with the provisions of applicable laws and regulations. This study examines the factors that led to the crime of child abuse resulting in death in decision number 1752/Pid.Sus/2022/PN Surabaya and the factors that the judge considered in imposing sanctions on the perpetrator. This study uses a normative juridical legal approach with a qualitative descriptive method, with data obtained from the court decision document number 1752/Pid.Sus/2022/PN Surabaya, interviews with related parties, and a review of legal literature. The results of the study indicate that the defendant's psychological condition, including post-partum emotional disorders and anxiety, are the main factors triggering violence against children. In addition, social factors such as domestic violence and economic pressure worsen the defendant's mental condition, while lack of social support also increases the risk of violence. In imposing sanctions, the judge considers the defendant's psychological condition, cooperative attitude, and socio-economic impacts, with the hope of providing a deterrent effect as well as an opportunity for rehabilitation. This study recommends that the legal system pay more attention to psychological factors in the process of criminal responsibility and the sanctions given, as well as the importance of a rehabilitation approach to prevent similar violence in the future.
