Comparison of Victim Trust Funds in Indonesia and the Netherlands in an Effort to Protect Victims of Sexual Violence
Perbandingan Victim Trust Fund di Indonesia dan Belanda dalam Upaya Melindungi Korban Kekerasan Seksual
Abstract
This research is motivated by the high rate of sexual violence and he limited fulfillment of victims’ rights, particularly in obtaining compensation and recovery. This study aims to compare the Victim Trust Fund system in Indonesia and the Wet Schadefonds Geweldsmisdrijven in the Netherlands in protecting victims of sexual violence. The research employs a normative legal method with statutory, conceptual, and comparative approaches. The results show that the system in Indonesia still faces obstacles because it depends on restitution mechanisms through court decisions and the implementation of the Victim Assistance Fund has not yet been optimal. In contrast, the system in the Netherlands is more effective because it provides direct compensation to victims through a simple, structured, and injury-category-based mechanism. This Study concludes that the Dutch System provides greater legal certainity and easier access for vicctims compared to Indonesia. Therefore, strengthening the implementation of the Victim Assistance Fund in Indonesia is necessary to ensure that the fulfillment of victims’ rights can be carried out more effectively.
