Perlindungan Satwa Langka Di Indonesia Yang Dipakai Dalam Upacara Adat Dari Perspektif Hukum Internasional
Abstract
This article analyzes the Convention International Trade in Endangered of Wild Fauna and Flora (CITES) which specifically regulates the protection of flora and fauna which fights for the preservation of wild or endangered animals for the sake of maintaining environmental ecosystems at the international level. Indonesia has ratified CITES through Presidential Decree Number 43 of 1978 concerning Indonesia's joining CITES. However, the reality is that the recognition of the existence of Customary Law communities in Article 18B of the 1945 Constitution of the Republic of Indonesia became controversial when endangered animals became a medium for completing traditional rituals which have mystical and sacred value.
