Kewenangan Penetapan Anggota TNI Sebagai Tersangka Dalam Tindak Pidana Korupsi
Abstract
Based on the Indonesian Constitution, all Indonesian people have an equal position in the eyes of the law (equality before the law), and are obliged to respect and obey the law and government without exception. The rule of law applies universally regardless of a person's status, so that state officials, businessmen, members of the Indonesian National Army/Indonesian Police, and ordinary people all obtain the same rights and positions before the law. This research uses normative juridical research methods with a statutory approach (Statute Approach), Case Approach and Conceptual Approach. The source of legal materials is in the form of primary and secondary legal materials. In terms of the collection of legal materials, sourced from literature studies, then analyzed qualitatively by processing legal materials and analyzing to obtain systematic and logical research results. Members of the Indonesian National Army are under the jurisdiction of the military courts when violating the provisions of military law, but are subject to the general court when committing violations of general criminal law or corruption crimes as part of the special criminal law. This condition occurs because there are various forms of violations both in terms of material and formality. The Military Police in the military environment is tasked with investigating Indonesian National Army personnel who commit crimes outside the general category. Therefore, the Corruption Eradication Commission, which is a special court institution, is authorized to handle the case, even if the perpetrator has active military status.
