Perlindungan Hukum Hak Cipta Atas Lagu Yang Discover Tanpa Hak Untuk Tujuan Komersial
Abstract
Copyright is a component of intellectual property rights that grants creators exclusive rights to utilize their work. Article 9, paragraph 3, prohibits anyone from duplicating or commercially using a work without the permission of the creator or copyright holder. However, in the digital era, copyright infringement is on the rise, particularly in the practice of song covers on YouTube, conducted without the creator's permission for commercial purposes. This harms creators, both morally and economically, necessitating clear legal protection to guarantee their rights. The research method used in this study is normative research conducted using a legislative approach, a case approach, and a conceptual approach. The legal sources used are primary, secondary, and tertiary legal materials, which are then analyzed using qualitative methods. The results of this study indicate that the act of covering songs without permission and uploading them to digital platforms violates the moral rights and economic rights of creators as stated in Law Number 28 of 2014, the form of protection is provided through preventive and repressive efforts and the settlement mechanism can be carried out through litigation or non-litigation, while the settlement process is through non-litigation such as negotiation, mediation, conciliation, and arbitration.
