Pengaturan Hukum Kewenangan Satuan Reserse Kriminal Dalam Pencegahan dan Penanggulangan Tindak Pidana Pencurian Kendaraan
Abstract
: The regulation of the authority of the Criminal Investigation Unit (Satreskrim) in preventing and combating motor vehicle theft remains predominantly focused on repressive functions through inquiry and investigation, while preventive authority has not been explicitly formulated within the existing legal framework. This condition has resulted in unclear limits of authority, regulatory disharmony, and suboptimal effectiveness in addressing motor vehicle theft, particularly in response to technological advancements and increasingly organized criminal networks. This study aims to analyze the existing legal framework governing the authority of Satreskrim in preventing and combating motor vehicle theft and to formulate an ideal regulatory model. This research employs a normative legal research method using statutory, conceptual, and comparative approaches. The legal materials consist of primary, secondary, and tertiary sources analyzed through a prescriptive legal method. The findings indicate that the current regulatory framework is weakened by the absence of explicit provisions integrating preventive and repressive authority, inadequate harmonization among relevant legal instruments, and insufficient regulation concerning institutional coordination, information technology utilization, and accountability mechanisms. Therefore, the ideal legal framework should strengthen the legal basis of preventive authority, harmonize relevant legislation, integrate intelligence-led policing and information technology into crime prevention strategies, reinforce coordination among police functions, and enhance accountability and legal certainty in order to improve the effectiveness and fairness of motor vehicle theft prevention and law enforcement.
