Pengaturan Hukum Kewenangan Kepolisian Dalam Penerimaan Dan Penanganan Laporan Tindak Pidana
Abstract
The receipt and handling of criminal offence reports constitute the initial stage of the criminal justice process, determining both the effectiveness of law enforcement and the protection of citizens' rights. Although the authority of the Indonesian National Police is regulated under Law Number 2 of 2002 concerning the Indonesian National Police, the Indonesian Criminal Procedure Code, and Regulation of the Chief of the Indonesian National Police Number 6 of 2019 concerning Criminal Investigation, the existing regulatory framework remains fragmented, contains overlapping authorities, and has not established a comprehensive and integrated mechanism for receiving and processing criminal reports. This study aims to analyse the legal framework governing police authority in receiving and handling criminal offence reports and to formulate an ideal regulatory model capable of ensuring legal certainty, accountability, and the protection of citizens' rights. This research employs normative legal research using statutory, conceptual, and comparative approaches. The legal materials consist of primary, secondary, and tertiary legal sources analysed through a prescriptive method based on library research. The findings reveal that the current regulations are dispersed across various legal instruments, resulting in inconsistent implementation of police authority, weak institutional coordination, and suboptimal oversight and public service mechanisms. Therefore, an ideal legal framework should integrate the principles of legality, due process of law, accountability, transparency, professionalism, proportionality, institutional harmonisation, and the utilisation of information technology within a comprehensive regulatory system. Such a framework is expected to strengthen legal certainty, improve the effectiveness of law enforcement, enhance the quality of police services, and increase public trust in Indonesia's criminal justice system.
