Formulasi Pengaturan Mediasi Oleh Bhabinkamtibmas Dalam Penyelesaian Permasalahan Keamanan dan Ketertiban Masyarakat Berbasis Keadilan Restoratif
Abstract
Mediation by Bhabinkamtibmas (community police officers) is one of the efforts to resolve public security and order issues through deliberation and restorative justice. However, the legal framework governing mediation by Bhabinkamtibmas has not been comprehensively regulated, resulting in uncertainty concerning their status, authority, implementation mechanisms, and the legal force of mediation agreements. This study aims to analyze the legal regulation of mediation by Bhabinkamtibmas in resolving public security and order issues under Indonesian positive law and to examine whether such regulation provides legal certainty in the implementation of restorative justice. This research employs normative legal research using a statutory approach and a conceptual approach. Legal materials were analyzed qualitatively through legal reasoning to identify the normative construction and problems concerning mediation by Bhabinkamtibmas. The results show that mediation by Bhabinkamtibmas has a functional legal basis through regulations concerning police duties, Community Policing, Bhabinkamtibmas, problem-solving, and restorative justice. However, these regulations remain fragmented and do not specifically regulate the position of Bhabinkamtibmas as mediators, the scope of their authority, the types of disputes that may be mediated, mediation procedures, or the legal force of mediation agreements. Therefore, the existing regulations have not fully provided legal certainty in implementing restorative justice, necessitating a clearer, systematic, and comprehensive regulatory reformulation.
