Mekanisme Penanganan Tindak Pidana Ringan Melalui Pendekatan Restorative Justice Oleh Polsek Jetis Polres Mojokerto Kota
Abstract
The implementation of restorative justice is an approach to handling minor criminal offenses that emphasizes victim restoration, offender accountability, and proportional conflict resolution. In practice, this approach must be implemented based on clear legal foundations and procedures to ensure legal certainty, justice, and social utility. This study aims to analyze the mechanism for handling minor criminal offenses through a restorative justice approach by the Police at Jetis Police Sector and to examine the factors influencing its implementation. This study employs normative legal research using a statutory approach and a conceptual approach. The legal materials consist of primary legal materials in the form of legislation and secondary legal materials comprising books, scientific journals, and relevant legal literature, which are analyzed using qualitative juridical analysis. The results show that the restorative justice mechanism for handling minor criminal offenses consists of receiving reports or complaints, assessing the applicable requirements, facilitating reconciliation and deliberation, fulfilling victims' rights and offenders' responsibilities, and resolving cases in accordance with the Indonesian National Police Regulation Number 8 of 2021. Its implementation is influenced by five interrelated factors: legal factors, law enforcement officers, facilities and infrastructure, society, and culture. Therefore, the effectiveness of restorative justice is not determined solely by the achievement of reconciliation, but also by compliance with legal procedures, victim protection, offender accountability, and the achievement of restoration.
