Pemberian Bantuan Hukum Kepada Institusi, Anggota, Dan Keluarga Besar Polri Dalam Menghadapi Masalah Hukum
Abstract
This study aims to analyze the legal regulation of legal assistance provided to the institution, members, and extended families of the Indonesian National Police (Polri) in dealing with legal problems and to examine the legal protection provided through such mechanisms based on the principles of the rule of law and legal certainty. This study employs normative legal research using a statutory approach and a conceptual approach. The legal materials consist of primary, secondary, and tertiary legal materials collected through library research and analyzed using qualitative juridical analysis. The results show that the provision of legal assistance within the Indonesian National Police has a legal basis in Law Number 2 of 2002 concerning the Indonesian National Police, Government Regulation Number 3 of 2003, Government Regulation Number 42 of 2010, and Regulation of the Chief of the Indonesian National Police Number 2 of 2017. These regulations govern the parties entitled to legal assistance, the forms of assistance, the scope of legal matters, and the procedures for providing such assistance. The provision of legal assistance constitutes a form of legal protection consistent with the principles of the rule of law and legal certainty, provided that it is carried out based on legitimate authority, clear procedures, and appropriate limitations on authority and legal accountability. Legal assistance does not constitute a form of privilege or legal immunity, but rather serves as an instrument to ensure the fulfillment of legal rights and a fair legal process.
