Pengaturan Kewenangan Kepolisian Dalam Pelaksanaan Pelayanan Lalu Lintas Sebagai Upaya Mewujudkan Kamseltibcarlantas di Indonesia
Abstract
This study aims to examine the regulation of police authority in the implementation of traffic services as an effort to achieve traffic security, safety, order, and smoothness (Kamseltibcarlantas), and to formulate an ideal regulatory framework for police authority in traffic services. This study employs normative legal research using statutory, conceptual, and analytical approaches. The legal materials consist of primary, secondary, and tertiary legal materials collected through library research and document studies and analyzed using normative qualitative analysis through descriptive, interpretative, evaluative, and prescriptive methods. The findings indicate that police authority in traffic services has a legal basis under the prevailing laws and regulations, particularly those governing the Indonesian National Police and road traffic and transportation. However, the existing regulatory framework remains fragmented, with unclear division of authority, non-uniform service standards, and insufficient regulation of police discretion, inter-institutional coordination, technology-based services, data protection, supervision, and accountability. Therefore, an ideal regulatory framework should emphasize regulatory harmonization, clearer division of authority, standardized services, strengthened coordination, appropriate regulation of technology and data protection, and effective supervision and accountability based on legality, legal certainty, professionalism, proportionality, transparency, and accountability to support the realization of Kamseltibcarlantas.
