Pengaturan Hukum Kewenangan Kepolisian dalam Pelaksanaan Patroli untuk Pemeliharaan Keamanan dan Ketertiban Masyarakat
Abstract
This study aims to analyze the legal framework governing police authority in conducting patrols as an effort to maintain public security and order and to formulate an ideal regulatory concept that ensures legal certainty and the protection of human rights. This study employs a normative legal research method using the statutory approach, conceptual approach, and analytical approach. The legal materials consist of primary legal materials in the form of legislation relating to police authority and patrol operations, secondary legal materials comprising books, scholarly journals, research findings, and expert opinions, as well as tertiary legal materials as supporting materials. Legal materials were collected through library research and analyzed qualitatively using legal interpretation and deductive reasoning. The findings indicate that police authority in conducting patrols has a legal basis within the Indonesian legal system, but the existing regulatory framework still requires strengthening, particularly regarding the clarity of the scope of authority, limits on police officers’ actions, the exercise of discretion, operational procedures, oversight mechanisms, and legal accountability. An ideal regulatory concept should therefore emphasize the harmonization and clarification of norms governing patrol authority in a systematic and measurable manner based on the principles of legality, legal certainty, proportionality, professionalism, accountability, and human rights protection.
